Coconut Cycles Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and Coconut Cycles (“Company,” “we,” “us,” or “our”) regarding your access to and use of the Coconut Cycles website, mobile application, and all related services, features, and content (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Service immediately.

We reserve the right to modify these Terms at any time. Updated versions will be indicated by an updated “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

The Service is intended for users who are at least 18 years old.

2. Description of the Service

Coconut Cycles provides a digital platform designed to help individuals organize and manage fertility treatment schedules, medications, procedures, laboratory appointments, and related information.

The Service may include calendar tools, reminders, protocol tracking, scheduling features, and informational resources intended to improve communication and organization between fertility patients and clinics.

The Service is provided for informational and organizational purposes only.

3. Medical Services Disclaimer

The Service does not provide medical advice, diagnosis, or treatment.

Coconut Cycles is not a healthcare provider and is not licensed to practice medicine. Any health-related information provided through the Service is intended for informational and organizational purposes only.

You should always consult with a licensed physician, reproductive endocrinologist, or other qualified healthcare provider regarding:

  • medical conditions

  • fertility treatments

  • medication instructions

  • medical decisions

Never disregard professional medical advice or delay seeking it because of information provided through the Service.

If you believe you are experiencing a medical emergency, contact emergency services immediately.

4. Medication Reminder and Scheduling Disclaimer

The Service may provide medication reminders, appointment notifications, or treatment schedule alerts.

These reminders are provided solely as convenience features and may not always function correctly due to device settings, network connectivity, user input errors, or technical issues.

You acknowledge and agree that:

  • You are solely responsible for following your prescribed treatment plan.

  • You must confirm medication instructions and timing directly with your healthcare provider.

  • Coconut Cycles is not responsible for missed medications, missed appointments, or treatment errors.

The Service should never be relied upon as the sole method of managing medical treatment schedules.

5. User Accounts

Certain features of the Service may require the creation of a user account.

You agree to:

  • provide accurate and complete information

  • maintain the security of your account credentials

  • promptly update your information if it changes

You are responsible for all activity occurring under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Data and Content

You may input information into the Service, including treatment schedules, medications, appointments, notes, or other personal information (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant Coconut Cycles a limited license to store, process, and display such content solely for the purpose of operating and improving the Service.

Although we perform routine backups, you are solely responsible for maintaining copies of important information entered into the Service. Coconut Cycles shall not be liable for any loss, corruption, or deletion of user data.

7. Health Information and HIPAA

The Service may allow users to store information related to fertility treatment protocols.

When Coconut Cycles provides services to healthcare providers that involve the creation, receipt, maintenance, or transmission of Protected Health Information (“PHI”), Coconut Cycles may operate as a Business Associate under applicable health privacy laws and may enter into Business Associate Agreements (“BAAs”) with healthcare providers.

In such circumstances, Coconut Cycles will implement administrative, technical, and physical safeguards designed to protect health information.

If you use the Service independently as a personal organizational tool and not through a healthcare provider relationship, your information may not be subject to HIPAA protections, though we apply reasonable privacy and security practices to protect user data.

8. Mobile Application License

If you access the Service through a mobile application, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the application on a device you own or control solely for personal use.

When the application is obtained through a mobile app store (such as Apple App Store or Google Play), the following additional terms apply:

  • The license granted is limited to use on devices permitted by the applicable platform.

  • The platform provider is not responsible for maintenance or support of the application.

  • Platform providers are third-party beneficiaries of these Terms.

9. Subscription and Payment

Certain features of the Service may require a paid subscription.

If you purchase a subscription through a mobile app store:

  • Payment processing is handled by the platform provider.

  • Subscription fees may renew automatically unless canceled before the end of the billing period.

  • Refund requests must be submitted through the platform provider.

Subscription pricing and features may change with notice.

10. Prohibited Activities

You agree not to use the Service to:

  • violate any applicable laws

  • attempt unauthorized access to accounts or systems

  • distribute malicious software or harmful code

  • interfere with the operation of the Service

  • harvest user information without authorization

  • impersonate other users

We reserve the right to investigate and take legal action against violations of these Terms.

11. Intellectual Property

All software, design, content, trademarks, logos, and materials associated with Coconut Cycles are the property of the Company or its licensors.

You may not copy, reproduce, distribute, modify, reverse engineer, or exploit any portion of the Service without prior written permission.

12. App Management

We reserve the right, but not the obligation, to:

  • monitor the Service for violations of these Terms

  • restrict or terminate user access

  • remove content that violates policies

  • take legal action when appropriate

13. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

By using the Service, you agree to the terms of the Privacy Policy.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the platform.

You may terminate your account at any time by discontinuing use of the Service.

15. Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

We do not guarantee uninterrupted or error-free operation of the Service.

16. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind.

We do not guarantee the accuracy, reliability, or completeness of information provided through the Service.

Your use of the Service is at your own risk.

17. Limitation of Liability

To the fullest extent permitted by law, Coconut Cycles and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the six (6) months preceding the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless Coconut Cycles and its affiliates from any claims, damages, losses, or legal expenses arising from:

  • your use of the Service

  • your violation of these Terms

  • your violation of applicable laws or third-party rights

19. Dispute Resolution

To reduce the cost of legal disputes, you and Coconut Cycles agree to resolve disputes through binding arbitration rather than court litigation, except where prohibited by law.

Any arbitration will be conducted on an individual basis and not as part of a class action.

Before initiating arbitration, both parties agree to attempt informal resolution for at least 30 days.

20. Electronic Communications and Signatures

By using the Service, you consent to receive electronic communications from us.

You agree that all agreements, notices, disclosures, and communications provided electronically satisfy any legal requirement that such communications be in writing.

You consent to the use of electronic signatures and records.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Utah, without regard to conflict of law principles.

22. Miscellaneous

These Terms constitute the entire agreement between you and Coconut Cycles regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision shall not constitute a waiver of that provision.
